1. Introduction
Welcome to Magic! These Terms of Service (“Terms”) govern your access to and use of the Magic platform, which refers to both the Admin Portal accessible at www.yourmagic.co (“Platform”) and the App. By using the Platform, you agree to comply with these Terms. If you are entering into this agreement on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.
 

2. Definitions
Platform: Refers to Magic, Singapore’s first community-centric booking platform, accessible via both the Admin Portal (for studios) and the App (for your members).
Admin Portal: The administrative interface of the Platform, accessible only by Studio Owners, Studio Staff, and Instructors.
App: The mobile application of the Platform, accessible only by Members for the purpose of booking classes, purchasing memberships, and managing their fitness schedules.
Studio Owners: Registered users with administrative rights over their studio’s account on the Platform. Studio Owners have the ability to create and manage Studio Staff and Instructor accounts.
Studio Staff and Instructors: Authorized personnel granted limited access rights by the Studio Owner to manage bookings and scheduling.
Members: Consumers who access the App to book classes, purchase memberships, and manage their fitness schedules. Members have no contractual relationship with Magic; their membership and usage terms are directly with their respective studios.
Third-Party Payment Provider: HitPay, which processes payments on behalf of the studios.
 

3. Effective Date
These Terms take effect when you create an account with Magic, regardless of whether you are on a free trial or a paid plan. This is a legally binding agreement between you and Magic, governing your use of our platform and services.
 

4. Services
Magic provides an online platform for boutique fitness studios to manage bookings, schedules, sell membership plans, and foster community engagement. Our services may also include various offerings from third-party providers, such as payment solutions and partner integrations. Access to these third-party services may be subject to separate terms and conditions imposed by the providers.

Additionally, we offer free trials and beta services for testing and evaluation. These are provided “as is” without warranties, may have limited features, and may not perform as reliably as the general release. Support services are available, though response times and resolutions may vary depending on the nature of your inquiry.

 

As part of our Beta Launch Offer, the first 10 studios that sign up will enjoy a 3-month free trial and a special rate of $99/month for an annual plan. This discounted rate applies for the first 12 months, after which Magic reserves the right to maintain or revise the pricing. While we strive to prioritize and build features most requested by our beta users, Magic does not guarantee the delivery of specific features and cannot be held liable for unmet expectations. Furthermore, as we enhance our platform with new features, Magic retains the discretion to decide whether these enhancements will be offered to the initial beta studios for free or at an additional cost.

 

5. Studio Responsibilities
As a studio, you are responsible for providing accurate and up-to-date information on your profile, maintaining the confidentiality of your login credentials, and ensuring that all interactions with customers adhere to applicable laws and regulations. You agree to use the Magic platform responsibly and solely for your studio’s legitimate business needs. You are also responsible for the accuracy of your payment information and for ensuring timely payment of your subscription fees.

 

6. Payments
Magic uses HitPay as its third-party payment provider. All payment terms, including processing, chargebacks, refunds, and any related disputes, are governed by HitPay’s terms and conditions, as agreed upon by the studio and HitPay. Magic is not liable for any issues arising from payment processing, and all inquiries should be directed to HitPay or the relevant studio.

All payments made under these Terms are non-cancellable, and all fees paid are non-refundable, including charges for any unused services. You are responsible for all applicable taxes related to your use of Magic. For overdue charges, Magic may apply interest at the rate of 2% per month or the maximum rate allowed by law, whichever is lower, until the outstanding balance is paid.

7. Content Liability
Magic shall have the right, but not the obligation, to monitor the content of www.yourmagic.co, including user-generated content such as announcements, promotions, or other material shared on the Platform. Magic reserves the right to edit, refuse to post, or remove any material that, in Magic's sole discretion, violates these Terms, applicable laws, or is otherwise objectionable. All content published by studios is their sole responsibility, and Magic disclaims any liability for inappropriate, misleading, or inaccurate content.

8. Intellectual Property
All content and materials available on the Platform, including but not limited to logos, trademarks, software, and design, are owned by or licensed to Magic and are protected by intellectual property laws. Users are not permitted to copy, modify, distribute, or exploit any part of the Platform without Magic’s prior written consent.

 

9. Limitation of Liability
IN NO EVENT SHALL MAGIC AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE SERVICES.

 

10. Platform Reliability Disclaimer
USER EXPRESSLY AGREES THAT USE OF WWW.YOURMAGIC.CO OR THE MAGIC APP IS AT USER'S SOLE RISK. NEITHER MAGIC, ITS AFFILIATES, NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS WARRANT THAT WWW.YOURMAGIC.CO OR THE MAGIC APPWILL BE UNINTERRUPTED OR ERROR-FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF WWW.YOURMAGIC.CO OR THE MAGIC APP OR THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE PLATFORM.

 

11. Data Ownership and Use
You retain ownership of all data you input into the Magic platform. Magic will use your data solely to provide and improve our services and for analytical purposes in aggregated, anonymized form. Magic respects your privacy and will not share your data with third parties without your consent, except as required by law or for service delivery purposes.

12. Changes to the Terms
MAGIC SHALL HAVE THE RIGHT AT ANY TIME TO CHANGE OR MODIFY THE TERMS AND CONDITIONS APPLICABLE TO USER'S USE OF WWW.YOURMAGIC.CO, OR ANY PART THEREOF, OR TO IMPOSE NEW CONDITIONS, INCLUDING, BUT NOT LIMITED TO, ADDING FEES AND CHARGES FOR USE. SUCH CHANGES, MODIFICATIONS, ADDITIONS, OR DELETIONS SHALL BE EFFECTIVE IMMEDIATELY UPON NOTICE THEREOF, WHICH MAY BE GIVEN BY MEANS INCLUDING, BUT NOT LIMITED TO, POSTING ON WWW.YOURMAGIC.CO OR BY ELECTRONIC OR CONVENTIONAL MAIL, OR BY ANY OTHER MEANS BY WHICH USER OBTAINS NOTICE THEREOF. ANY USE OF WWW.YOURMAGIC.CO BY USER AFTER SUCH NOTICE SHALL BE DEEMED TO CONSTITUTE ACCEPTANCE BY USER OF SUCH CHANGES, MODIFICATIONS, OR ADDITIONS.

 

13. Compliance with Singapore Laws
Users agree to comply with all applicable Singaporean laws, including but not limited to the Personal Data Protection Act (PDPA). For further details on data handling and privacy, please refer to our separate Privacy Policy.
